Kayihura’s woes draw in Kabafunzaki’s AYA saga

On April 8, 2017 Herbert Kabafunzaki, the former State Minister for Labour got arrested from Serena hotel taking a bribe from the proprietors of Pearl of Africa hotel to stop pursuing the sexual harassment cases against them.

Disgraced and embarrassed, Kabafunzaki was suspended from his ministerial position as he faced corruption charges before the Anti-corruption court at Kololo in Kampala.

It has now turned out to have been a well-choreographed plot to set up the Rukiga MP and divert the public from the shocking murder of former police spokesman AIGP Andrew Felix Kaweesi.

According to well-placed security sources, Kabafunzaki was set up by operatives who were working under then Inspector General of Police (IGP) Gen Kale Kayihura who according to investigations by the Chieftaincy of Military Intelligence (CMI) worked with the AYA brothers to set up Kabafunzaki such that he could divert media and public attention from the Kaweesi murder.

This came to the fore following last week’s arrest of Lt Eric Kagina who oversaw the execution and eventual arrest of the embattled former minister, 20 days after Kaweesi’s assassination.

Lt Kagina initially worked under President Museveni’s elite unit; the Special Forces Command (SFC) but was dismissed after being implicated in a case of extortion. He tried his luck at CMI but was rejected before getting in touch with Nixon Agasirwe, the former head of Special operations in police.

Agasirwe introduced him to Kayihura who assigned him to work with Agasirwe, and allocated him an office at the Central Police Station Kampala. Agasirwe is also under detention.

According a source close to the investigations, Lt Kagina worked with Brian Mugabo, one of Kabafunzaki’s mobilisers in Rukiga to trap him.

Through Mugabo, Lt Kagina and his group learnt that Kabafunzaki was taking his daughter for lunch at Serena Kampala hotel.

The sexual harassment case against the wealthy AYA boss had already been swallowed by Kaweesi murder that Kayihura’s men saw great opportunity in trapping Kabafunzaki had put himself at the forefront of the case.

The CCTV footage that CMI obtained from Serena hotel shows how Mugabo descended from up the restaurant to the ground floor and struggled to return with Kabafunzaki up where Hamid Mohammed, the chairman of the AYA group was already seated and waiting for them.

Meanwhile Lt. Kagina had already arrived with his team and journalists waiting for the events to unfold.

Moments later, Kabafunzaki was arrested and driven to the now closed Nalufenya detention facility.

It has also been established that Hamid recorded a statement at CPS on April 10 2017, two days after the arrest, which has raised suspicion among the army investigators as regards the interest of the police in the case.

This, according to the source made the police appear to be the complainant in the case and at the same time the investigator.

A bribery complaint had recorded a bribery complaint against Kabafunzaki in the morning of April 8, 2017, hours before Kabafunzaki was caught red-handed receiving the bribe. The complaint was made by police detective only identified as Okello who was handling the sexual harassment case.

A month later, on May 7, 2017 when they were produced before the Anti-Corruption court, Mugabo, in a letter to the Director of Public Prosecution and Anti-Corruption court, pleaded that his political boss be exonerated since he (Mugabo) is the one who asked for the bribe money from the AYA boss.

“I wish to sincerely apologize for asking for money and receiving the same from Aya. I thought I would make quick money out of Aya but my actions have landed me into problems and I regret. I wish to take personal responsibility and avoid wasting court’s time,” Mugabo stated in his letter.

The letter was read to court by lawyer Ochieng Evans.

Mugabo admitted that he didn’t pick the money on behalf any person and in this case the suspended minister.

“I had earlier pleaded guilty but when I read the charges again, I changed because it was saying I had asked for the money on behalf of others yet I had asked for the money on my own and had it myself which I regret,” he added.
